1. Scope

The following General Terms and Conditions (GTC) apply to all services provided by Butterblümchen GbR, Kölnstraße 195 in 53111 Bonn. In our premises, the "Ponyhof", we offer events on the subject of wine (www.ponyhofzuverkaufen.de). You can also use the "Ponyhof" to work creatively with colleagues or customers (www.ponyhofzuvermieten.de).

 

Unless we agree otherwise with you, these terms and conditions always apply. If you have your own terms and conditions that differ from our GTC, then these only apply if we expressly agree to them in writing. Even if we do not mention it specifically, these terms and conditions also apply to all future business relations between us. Always up to date: The latest version of our GTC always applies.

2. Contract Conclusion

Before you use our services, the service contract must be completed. You can do this both online and directly at our premises.

What you see on our website about the Ponyhof and the events there is not a firm commitment on our part. It is rather an invitation to you to make us an offer. Only when we confirm in writing - either by e-mail or on paper - that you can rent the room or the equipment, will a binding contract be concluded.

3. Ponyhofzuvermieten

 

Use, price, payment modalities and cancellation 

 

You may only use the Ponyhof for joint work, workshops, seminars and similar events with up to 12 people. Do you want to use it for other purposes? Then you need our written permission.

 

We expect you to leave the room as you found it. Please use it only as it is intended.

 

Sometimes unforeseeable things can happen, such as force majeure, which are beyond our control. In such cases, we regret that you will not be able to work with us. If you have already paid, we will give you your money back. But we cannot cover travel, accommodation or other costs.

 

You are responsible for what happens during your use of the Ponyhof, be it a workshop, seminar or other event.

 

After you have received confirmation from us for your use, we will send you an invoice. Please pay this without deductions. The prices are based on our current price list or the offer we have made you.

 

Do you want to cancel? Then please write to us at hallo@ponyhofzuvermieten.de.

 

If you cancel more than 7 days before your appointment, we will give you your money back but keep 5 EUR as a handling fee. If you cancel between 48 hours and 7 days before your appointment, we will refund half your money. If you cancel less than 48 hours in advance, we unfortunately have to keep the full price. Unless you find someone to take your place and pay for it.

4. Ponyhofzuverkaufen

 

Use, price and payment modalities

 

We, the Butterblümchen GbR, organise various tasting events, especially on the subject of wine. You can buy tickets for these events, which entitle you to participate on the day of the event. Once you have bought a ticket, you cannot exchange it. But you can give it to someone else if you cannot attend. 

 

You can pay for your ticket using the payment methods displayed in the checkout process. If there are any additional fees or charges when you book your ticket, we will show you clearly in the booking process.

 

Sometimes things happen that we cannot control, such as force majeure or other unexpected events. In such cases, we may not be able to hold the event. If we have to postpone the event due to such reasons, you can participate in the alternative date. If this date does not suit you, we will refund your money if you cancel at least 48 hours before the new date. Unfortunately, we cannot cover travel, accommodation or other costs.

 

When used without booking additional options, "1 full day" corresponds to the period from 8.00 a.m. to 6.00 p.m. Longer usage times up to a maximum of 9 p.m. are possible by arrangement.

5. Right of withdrawal

 

You have the right to cancel this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.

 

In order to exercise your right of withdrawal, you must inform us (Butterblümchen GbR, Kölnstraße 195, 53111 Bonn, Germany, email address: hallo@ponyhofzuvermieten.de) of your decision to withdraw from a contract by means of a clear declaration (e.g. a letter sent by post, email). 

 

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

 

Consequences of the revocation

 

If you cancel a contract, we must refund all payments we have received from you, including delivery costs, immediately and at the latest within fourteen days of the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

 

If you have requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal in respect of this contract compared to the total scope of the services provided for in the contract.

 

Statutory exceptions Right of withdrawal

According to the legal regulations, there is no right of withdrawal for contracts for the provision of services in the areas of accommodation for purposes other than residential (...) supply of food and drink as well as for the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for the provision (§312 g para. 2 no. 9 BGB). 

 

Accordingly, there is no right of cancellation for room reservations at the Ponyhof or for tastings booked for a specific date. There is also no right of cancellation for tickets booked for specific events.

6. Rules of Conduct

 

When visiting the Ponyhof or participating in events, please adhere to the current house rules.

Our staff on site may give you instructions. They only do this to ensure that everything runs smoothly, everyone is safe and the house rules are adhered to.

We, the Butterblümchen GbR, reserve the right to give you a warning if you do not behave appropriately. In the case of particularly serious offences, we may ask you to leave the premises or terminate this contract immediately and without notice.

 

The following are strictly prohibited:

• Use in connection with sweepstakes, pyramid schemes, chain letters, spam or any other type of unsolicited message or advertisement.

• Providing, downloading or processing data containing images, films, software or other material that is subject to intellectual property laws, unless the user is the copyright holder or owns the rights of use and exploitation.

• Dissemination of data containing viruses, Trojans, worms, bots or other malicious software.

• Unlawfully obtaining information from other users without their consent; providing false identity data.

• Dissemination of offensive, immoral, inciting, pornographic or other unlawful material or data or other violations of legal provisions (in particular violation of the provisions on the protection of privacy and personal rights).

 

Furthermore, the following is not permitted

• Loud music and other loud disturbing noises

• Smoking

 

The following is only permitted in consultation with us: 

• Bringing pets

 

If we discover that criminal offences are being committed on our premises, we will report this immediately to the relevant authorities.

7. Liability

 

You must treat the equipment and objects used with care. You are liable for any damage and excessive wear and tear caused by non-contractual use.

You must return keys issued to Butterblümchen GbR at the end of the contract. If the key is lost you are obliged to pay compensation to the value of the lost key. If you can prove that only minor damage or no damage at all has occurred, you will only owe the proven amount.

Butterblümchen GbR is only liable within the framework of this contract for intentional or grossly negligent fault on its part or that of its vicarious agents. In particular, Butterblümchen GbR is not liable for the replacement of valuables lost in the Ponyhof.

8. Final provisions

​

Butterblümchen GbR reserves the right to amend these GTC - with the exception of the essential contractual obligations - for future transactions. Changes or additions to these GTC must be made in writing. This may affect in particular the type, price and scope of services of the events and booking models.

 

If individual provisions of these GTC are invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, the validity of the rest of the contract remains unaffected.

 

Butterblümchen GbR stores and processes data related to its service, which may also be personal data. This is done within the legally permissible framework and with the utmost care. You can find more details in our privacy policy.

 

Any use of the services offered by Butterblümchen GbR in connection with the Ponyhof is subject exclusively to German law. This also applies if you come from a country other than Germany or register from this country.
